1. Acceptance of Terms
By using the Pxlit video editing application (the "App"), you agree to be bound by these Terms of Service ("ToS"). If you do not agree to these terms, do not use the App.
2. License Grant
Pxlit grants you a personal, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal or commercial purposes, subject to the terms and conditions of this ToS.
3. Use of the App
You may use the App to select input media files such as video, audio, and text and convert them into video output files. You may also perform editing operations on the media, as described in the End User License Agreement (EULA).
4. User Account
To access certain features of the App, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account information and agree to accept responsibility for all activities that occur under your account
5. User Content
By using the App, you may create "stories" by selecting and editing media files. You retain ownership of your content. However, by creating "stories," you grant Pxlit a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute your content for the purpose of operating and improving the App.
6. User Conduct
You agree not to use the App for any illegal or unauthorized purpose. You must comply with all applicable laws and regulations.
7. Termination
Pxlit may terminate or suspend your account and access to the App at any time for any reason, without notice. Upon termination, you must cease all use of the App.
8. Privacy
Your use of the App is also governed by our Data Privacy Agreement. By using the App, you consent to the collection, use, and sharing of information as described in the Privacy Agreement.
9. Intellectual Property
Pxlit retains all rights, title, and interest in and to the App, including all intellectual property rights.
10. Disclaimer of Warranty
The App is provided "as is" without any warranty of any kind. Pxlit disclaims all warranties, whether express, implied, or statutory.
11. Limitation of Liability
In no event shall Pxlit be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
12. Governing Law
This ToS shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States.
13. Changes to the ToS
Pxlit reserves the right to modify these Terms of Service at any time. Your continued use of the App after such modifications will constitute your acceptance of the modified ToS.
14. Third-Party Hosting Providers
Pxlit utilizes third-party hosting providers to store and manage user data. While Pxlit takes reasonable measures to ensure the security and reliability of these providers, we cannot guarantee against data breaches or service interruptions caused by factors beyond our control.
In the event of a data breach or service interruption attributable to our third-party hosting providers, Pxlit shall not be held responsible for any resulting loss, damages, or unauthorized access to user information. Pxlit will, however, make reasonable efforts to work with the hosting providers to rectify such issues promptly.
Users acknowledge and agree that their use of the App is subject to the terms and conditions of the third-party hosting providers, and any claims or liabilities arising from issues related to these providers will be governed by those terms.
Pxlit recommends that users review the privacy policies and terms of service of our hosting providers to understand their practices and procedures regarding data security.
15. Indemnification
Users agree to indemnify and hold Pxlit, its affiliates, officers, employees, and agents harmless from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising out of or in connection with any breach of these Terms of Service, including but not limited to issues related to third-party hosting providers.
